K-3 (Spouse of U.S. Citizen)
K-3 Visas allow for the foreign spouse of a U.S. citizen to travel to the United States to visit while their immigrant petition is pending. This visa is available for two year periods. The minor children of K-3 beneficiaries may also be granted admission under the K-4 visa classification.
To be eligible for the K-3 visa, the U.S. citizen spouse must file an I-130 petition as well as an I-129F with USCIS in the United States. Upon approval of the I-129F, but prior to the approval of the I-130, the foreign-based spouse will be able to apply for a visa abroad and subsequently travel to the United States.
